 FAA Compliance Issues Minimize

The FAA notified the City of San Diego on August 25, 2005 that because of inaction to corrrect non-compliance issues at Brown Field, enforcement actions would include the withholding of grant funds to Brown Field. In their letter, the FAA noted that these issues were first identified in July 2004 and had not been corrected during an inspection in July 2005. The FAA requested six actions:
  1. Update list of non-aeronautical uses at Brown Field and the plan to eliminate them
  2. Update the lease information summary and map
  3. Plan to remove parking on the ramp by the Border Patrol
  4. Provide a copy of the lease for the Border Patrol
  5. If non-aeronatical uses cannot be relocated soon, explain why and forecast when
  6. If non-aeronautical uses should be approved on an interim basis, identify the uses and explain why

On September 28, 2005, the City of San Diego responded with a letter and six attachments. The letter responded to each request:
  • the progress in eliminating non-aeronautical uses in city-controlled leases and in subleases with aviation tenants
  • an updated list of leases
  • an explanation requesting interim use approval for parking by the US Border Patrol
  • a copy of the sublease from Paladin to the US Border Patrol
  • a request for interim use approval of the detention facility of the US Border Patrol (located right at the entrance to Brown Field)
  • a request to approve the retention of the US Border Patrol on the airport ramp and hangar on the Paladin leasehold
The city letter also requests clarification of enforcement action of withholding grant funds, especially related to the Brown Field lighting project, which has increased in cost significantly due to FAA required changes. Is that a pre-approved grant or a withheld grant?

As of October 6, 2005, no response from the FAA.
